    What are the guidelines in considering a past criminal record?

    In 1994, I was caught growing cannabis in Amsterdam while living there with my then Dutch wife. I served a short community service sentence with no fines. I have since been divorced from my Dutch ex and have lived in America for the last 9 years. Since this arrest, I have never been in trouble with law enforcement.
     
    I need to know if my past criminal record will have any effect on any decision that is made in regards to a future application for a "eenmanszaak" under the auspices of the DAFT treaty. I would like to know if such a decision is made by a case-by-case basis and if there is a statue of limitations related to such an offense. I noticed this in the brochure "werkenalszelfstandig-eng.pdf" (dated 2002) that I recently read. It states the following:...  more

I, being an American father of 2 Dutch children am not allowed to be with my children and live like any normal Dutch father can live. I have no rights! I feel it to be so immoral to forcibly seperate Dutch children from their foreign born parents. Do you realize that this policy not only hurts me but my children as well? Why should either of us be punished but to punish my beloved kids because of their father is not Dutch is a VIOLATION OF HUMAN RIGHTS!!
     
    I would appreciate anyone's opinion on this. I would also appreciate any support I can receive from ANYONE in the Netherlands who can assist me in reuniting with my Dutch children.

    Dutch kids, I am not allowed to even live a normal life due to this

    immoral restriction. Even the European Commissio n

    states that the Dutch government is committing grave human rights

    abuses. If my case isn't a human rights abuse than I'm aghast as to what

    you would call it! They are not only hurting me but the well being of

    my children who dearly misses their Papa. Why does this have to be such a

No, it's not just "Cali" or Colorado that is on the verge of fully accepting cannabis as a legal and viable solution for the problems that exist in many areas of society (financial, environmental, medical, and social). There are now 16 states that have decided to enact medical marijuana rights to patients - so much for the "that's it" mentality.     I don't understand your position when you talk of the increased strengths of cannabis when you prefer a more concentrated form of cannabis called hashish which possibly 10 times more potent than White Widow (e.g.) or any other strain for that matter.
    You know what is really interesting is that you can buy Hash Oil over the counter in Colorado and California with very high THC levels. They are sold in various flavors and are considered to be a viable medicine by the State because of its ability to ease chronic bodily ailments such as arthritis and other muscle, bone, and nerve ailments - due soley to its higher THC content. Hash Oil is considered a hard drug under the 1976 Opium Wet. This is an example of how backward and misguided the Opium Wet is.  less

The argument of today's pot is 5 times more powerful than yesterday's is just bogus. Also, the manipulation of cannabis to achieve more potent strains is no different than manipulating tulips to exhibit different colors and shapes. Genetic modification in regards to flowers is not a problem for me. Genetic modification of our food is. But that deserves a different thread.  less

Thanks to the indifference of the IND and their lack of respect for reunification of family members means my DUTCH sons have to go without their loving father in their lives. There is nothing more immoral or heartless than this policy.... except for the Dutch ex.

    - Have a valid passport.

    - Not have a criminal record. You will have to sign a
    statement about your past to confirm this.

    Netherlands.
    - Have an Authorization for temporary stay (if you
    come from a country where you need to have such
    an authorization).
    - Have sufficient means of support. You must earn
    enough money from your profession or business to
    be able to pay for your own living expenses. Your
    net income must be 81% of the gross income (the
    gross profit).

     

    This is the only place that I have seen such a restriction. Considering it was a non-violent offense that occurred 18 years ago and that I served my punishment, I would like to now if any considerations are considered on an ad hoc basis. I am a loving father of 2 Dutch children and I have proven to not be a detriment to any society I live in so I would like to hear from anyone who might be able to provide me with any relevent information concerning my particular situation.
