  Wow sorry for your situation ... I remember you from years ago.
  
  I think you need a Divorce Lawyer to help answer these detailed 'parent plan' questions though. All the lawyers here are immigration lawyers.

  i asked a divorce lawyer here on the : ask the experts but sadly nobody replied to my question

  guess my best solution would be to see my lawyer who dealt with my case and proceed from there

  Really sorry for your situation.
  
  I have several friends that are in simular positions ... with difficult decisions to make with lawyers and ex's so I am always listening to the latest.
