Hi all,
I have questions about my resident permit. I currently hold a Dutch resident permit and it will expire in August.
My permit track is as follows:
Permit 1: 19 September 2007 - 19 September 2011 as a Knowledge migrant
In August 2011, I need to extend my permit. My husband is Dutch, so I changed my permit status from KM to a partner.
Permit 2: applied in August 2011, valid til 23 August 2012 as a partner
However, it says now in my resident card, datum afgifte: 04-11-11.
I calculate the duration of my stay is 4 years and 11 months.
My questions are:
1. I receive a letter again for extending my permit as a partner. Since I think I almost hit my 5 years mark, do you think it worth the while to ask for a permanent RP?
Or would the IND just throw my application away because my stay is 1 month less than the period they require?
I just do not want to pay twice this year. If I extend my permit as a partner, I have to pay 375 euro and one month later when I apply for a permanent resident permit, i have to pay 400 euro. :(
2. If I extend my permit as a partner, how long would it last? I might will not change my permit to a permanent resident permit, if the duration of the partner permit is also 5 years.

I agree. You need to apply for the Permanent Residence permit in advancs so if you are 1 month shy of 5 years .. apply for it immediately. The only catch is.. with the new rules, you have to show proof that you have passed the Dutch language test. Other than that ... I 99.999% sure you will gain a Permanent Residence permit.
Only thing is .. if you are an EU citrizen .. you don't need a Residence permit to live here - it's just nice to have.
I think if yiou have a Dutch resident permit that is going to expire .. this means you are Non- EU so you definitely need the Permanent Residence permit. You want the form:

Thanks for your reply. I really appreciate it. However, it is too late now. I already submitted my application for an extension as a partner. I called the IND around two weeks ago. And IND told me that I have to live here for 5 years, not 1 day less. :( IND also informed me that they counted the duration of stay day per day. I was quite surprise to hear that. I am now wondering if I call IND again and talk to another person, maybe I will get a different answer. :(

And you are correct, ouloveit3, I am a non European citizen.
One more thing, I do not have the Dutch language test. I will do a staatexamen though. I went to the gamentee last year, did a test at a dutch language school and they told me I do not need to do an inburgering because my dutch is quite good already. Furthermore, I have a certificate for a pre advance Dutch language from the university of Amsterdam. However the gamentee asked me if I want to do a staatexamen and I agreed to it. I will have the examen this year btw.

SURELY if you call again .. you will get another answer. :) This is because the IND number is not a Helpdesk - but logic tells you that once they say something - it must be true. Nope.

I think you can cancel it - sure. I would call and ask for the address and send a letter that has to be signed for - which says you would like cancel that application. Keep the return receipt proof that you cancelled it. (In fact, whenever you send something to the IND, send it such that someone has to sign for it and keep the return receipt!)
Then apply for the Permanent residence permit. This is permanent and does not have to be renewed EVER. Although every 5 years you will fill out a short form and enclose a new foto so that they can press a new card for you. This is not a renewal though. It's like having a new passport pressed every X years. You don't have to prove you are still a citizen of your home country though. :)
This is infinitely better than getting a permit based on your partner.
The thing is .. the IND does not refund money. EVER. Once you send your money in for the first application ... it is spent so that money is gone. Forget about getting it back.
However, look at the long term picture. You are better off losing that money and starting all over again for the permanent residency permit (which now doubles as an EU Perm permit) because again it's Permanent. The only way you can lose it is if you go to jail for a crime that's more 5 years prison time - as then they will deport you. :) Or if you leave the country and/or the EU for X time ( I forget how much time now) . Other than these things - you can never lose your permanent residency.

I thiink this staatexamen might be enough but I am not sure. Do print out the application and read it carefully. (When I got the perm residence permit years ago, they did not have a language requirement - this started last year I believe - so I am not sure if what you have will suffice.)
