1) If your Missus is still an official Slowakian National (with passport, etc.) she is an EU citizen and has free access to NL. The same goes for her children, unless they are born and registered in Oz. If she is a EU citizen, she can "sponsor" you as her spouse. BTW, as an Australian YOU will always need an MVV for any stay in the NL longer than three months!
However, if she became Australian and lost her Slowakian nationality, she is no EU citizen anymore and cannot travel and work free in the European Union.
In such a case she would have to follow all the normal procedures reserved to Australia, NZ and the United States (among others): she would need a MVV, follow a compulsory integration course and a language course. MVV's (Machtiging tot Voorlopig Verblijf) are delivered by the IND for 1 year and prolonged successively for other years. After 5 years (3 years if one is married or stays in a stable relationship) one can choose to adopt Dutch citizenship which also goes with a "toets" (exam).

Emilio...those countries do not need MVVs and therefore would not do the course and test to qualify for an MVV. But that's neither here nor there; that process is only for people (men OR women) who are moving here for DUTCH partners. If she's lost her EU nationality, they would have no right to be here at all. She couldn't apply for residency under any category because none would apply. I don't think they've started the American-style "points system" here yet...

As Emili wrote, after 3 months , i need an MVV, is this correct ? How long does it take till i get my sponsorship, once she sponsors me ? Can i live in NL during that duration on that basis past 3 months ?

No...you are Australian; you don't need an MVV. You can just visit the IND while you are here and fill out the sponsorship forms. It doesn't take that long to get approval and you can stay here in the meantime.
I'm just concerned that your wife will need to prove a steady income first to sponsor you. That will be the sticky bit.

Have you been to the IND website? All your options are there...And there are no "grey" areas...It's pretty cut and dried.
Still wondering why Germany isn't an option...Have you no more IT contacts or networks there? Easier than trying to establish new ones, especially from Oz...
